1. Who is responsible for your data

Machinery Planet FZ LLC, of Jumeirah Lake Towers, Cluster R, Unit R6, Dubai, United Arab Emirates, is the controller of personal data processed through the Platform.

2. The data we collect

Account and profile data, which you give us when you register:

• Name, email address, telephone number, company name and country.
• Your password, stored in hashed form — we never store it in plain text.
• Any additional profile or business details you choose to add, such as a company logo or seller description.

Listing data, which you give us when you advertise equipment:

• Equipment details: make, model, year, hours, condition, specification, price and location.
• Photographs, videos and supporting documents you upload.

Enquiry and transaction data:

• The content of enquiries and messages you send to sellers or to us, and our replies.
• Records of quotes, orders, inspections and transactions you take part in.
• Billing details where you purchase a paid service. Card details are handled by our payment or escrow provider and are not stored by us.

Technical and usage data, collected automatically as you browse:

• IP address, approximate location derived from it, browser type, device type and operating system.
• Pages and listings you view, searches you run, referring URLs, and the dates and times of your visits.
• Impression and page-view records used to produce performance statistics for sellers.
• Cookies and similar technologies — see the section on cookies below.

We do not intentionally collect special categories of personal data (such as health, biometric or religious data). Please do not include such information in listings or messages.

3. How and why we use your data

We use personal data to:

• Create and administer your account, and authenticate you when you log in.
• Publish your listings and make them findable by buyers, including through search engines.
• Pass enquiries between buyers and sellers, and enable you to be contacted about equipment.
• Provide sellers with statistics on how their listings perform, such as views and enquiry counts.
• Operate the Pro programme and auctions, including arranging inspections and escrow where applicable.
• Take payment, issue invoices and keep accounting records.
• Provide customer support and respond to your questions.
• Detect, investigate and prevent fraud, misuse, spam and security incidents.
• Improve the Platform — understanding which categories, searches and pages are useful.
• Send service messages you need to receive, such as verification codes, enquiry notifications and changes to our terms.
• Send marketing about equipment, features or offers, where you have consented or where we are otherwise permitted to do so.
• Comply with legal obligations, including tax, accounting, sanctions and anti-money-laundering requirements.

4. Our legal bases

Where data protection law requires us to identify a legal basis, we rely on the following:

• Performance of a contract — to provide the account, listing and transaction services you have asked for.
• Legitimate interests — to operate, secure, market and improve a marketplace, to produce seller statistics, and to prevent fraud. We balance these interests against your rights.
• Consent — for optional marketing communications and non-essential cookies. You can withdraw consent at any time.
• Legal obligation — to meet accounting, tax, regulatory and law-enforcement requirements.

5. Contact details shown to other users

Machinery Planet is a marketplace, so some of your data is deliberately visible to other users.

• If you publish a listing, the equipment details, photographs, location and your seller name or company are public, and can be indexed by search engines.
• Seller telephone numbers and email addresses may be shown, in full or partially masked, so that buyers can make contact.
• If you submit an enquiry, your name, contact details and message are sent to the relevant seller so they can respond to you.

Once a seller has received your enquiry, they act as an independent controller of that data and their own privacy practices apply. Please do not publish personal data in a listing that you do not want to be public.

6. Who we share data with

We share personal data with:

• Buyers and sellers, as described in the section above.
• Hosting and infrastructure providers who run our servers, storage and content delivery network.
• Email and messaging providers who deliver verification codes, enquiry notifications and newsletters.
• Analytics and advertising providers who help us understand and promote the Platform.
• Inspection providers and escrow providers, where you take part in a Pro transaction.
• Payment providers, where you purchase a paid service.
• Professional advisers such as accountants and lawyers, where necessary.
• Authorities, regulators or law enforcement where we are legally required to disclose, or to establish or defend legal claims.
• A buyer or successor, if we restructure, sell or transfer part of our business.

We require our service providers to process personal data only on our instructions and to keep it secure. We do not sell your personal data.

7. International transfers

We operate internationally and our buyers and sellers are located in many countries. Your personal data may therefore be transferred to, stored in, or accessed from countries outside the one in which you live, including countries whose data protection laws differ from those in your jurisdiction.

Where we transfer personal data internationally, we take steps to ensure an appropriate level of protection, such as contractual safeguards with the recipient. You may contact us for more information about the safeguards we use.

8. How long we keep data

• Account data: for as long as your account is open, and for a reasonable period afterwards to handle queries and legal claims.
• Listing data: while the listing is live and for a period afterwards, so that transaction history and statistics remain available.
• Enquiry and message data: for as long as needed to support the transaction and resolve any dispute.
• Detailed impression and page-view records: for a limited rolling window — currently around 60 days — after which they are deleted and only aggregated statistics are retained.
• Invoices and accounting records: for the period required by UAE tax and company law.

Aggregated or anonymised statistics, which can no longer identify you, may be kept indefinitely.

9. Cookies and similar technologies

We use cookies and similar technologies to keep you logged in, remember your preferences such as language and currency, keep the Platform secure, measure how it is used, and support our marketing.

• Strictly necessary cookies enable core functions such as authentication, security and load balancing. The Platform cannot work properly without them.
• Preference cookies remember choices such as your language and currency.
• Analytics cookies help us understand which pages, searches and listings are useful.
• Marketing cookies may be set by advertising partners to measure campaigns and show relevant adverts.

You can control cookies through your browser settings, including blocking or deleting them. Blocking strictly necessary cookies will affect how the Platform works.

10. Security

We take appropriate technical and organisational measures to protect personal data, including encryption of traffic in transit, hashed password storage, access controls, and monitoring for unusual activity.

No online service can be completely secure. You play an important part too: use a strong, unique password, keep it confidential, and tell us promptly if you suspect any unauthorised access to your account.

11. Your rights

Depending on where you live, you may have some or all of the following rights in relation to your personal data:

• Access — to be told what personal data we hold about you and to receive a copy.
• Correction — to have inaccurate or incomplete data corrected.
• Deletion — to ask us to delete data where there is no good reason for us to keep it.
• Restriction — to ask us to limit how we use your data while a concern is investigated.
• Objection — to object to processing based on our legitimate interests, and to object to direct marketing at any time.
• Portability — to receive certain data in a structured, commonly used, machine-readable format.
• Withdrawal of consent — where we rely on consent, to withdraw it at any time without affecting earlier processing.

To exercise any of these rights, email [email protected]. We may need to verify your identity before acting. We will respond within the period required by applicable law. Note that deleting your account does not automatically remove content that has already been indexed or cached by third parties such as search engines.

If you are not satisfied with how we have handled your request, you may complain to the data protection authority in your country. In the United Arab Emirates this is the UAE Data Office.

12. Marketing

You can opt out of marketing emails at any time using the unsubscribe link in the message, or by contacting us. Opting out of marketing does not stop service messages you need to receive, such as verification codes, enquiry notifications, or notices about changes to our terms.

13. Third-party sites

The Platform links to third-party websites and services, including seller websites, escrow providers and social media. We are not responsible for their content or privacy practices. Please read their privacy notices before providing them with personal data.

14. Children

The Platform is intended for business users and is not directed at children. We do not knowingly collect personal data from anyone under 18. If you believe a child has provided us with personal data, contact us and we will delete it.

15. Changes to this policy

We may update this Privacy Policy from time to time. The version published here is the version that applies, and the "Last updated" date at the top shows when it last changed. Where a change is material, we will take reasonable steps to notify you.
